(“Cycle Scene/we/our/us”).

As a user of this website (“you/your”) you acknowledge that your use of this website and any orders/transactions you make using this website are subject to the following terms and conditions.

1 General

1.1 This website is offered as a free service to you. Your use of the website constitutes your agreement to all the terms of use detailed below.

1.2 This website is owned by Cycle Scene and is protected by copyright and database rights. You may not reproduce any part of the website in any form unless we agree in writing in advance, except as necessary to use the website in accordance with these terms and conditions, or to keep a record of a transaction between you and us. 

1.3 The content of this website is intended for general information purposes only. We do not accept any liability for any loss arising as a result of reliance on the information contained on this website.

1.4 We retain the right to establish any hypertext links between this website and any third party website at our discretion.

1.5 If you choose to use such a link as detailed in clause 1.4 then you will leave this website, whether or not you realise that you are leaving and we are no longer responsible for the material on the other website that you enter. We exclude to the fullest extent permitted by law all liability that may arise in connection with or as a result of such external website material causing any damage, costs, injury or financial loss of any kind howsoever such damages arise.

1.6 Whilst we try and ensure that all the information on this website is accurate, errors may occur from time to time and we accept no liability for such errors. If we discover an error we will amend the website as soon as reasonably possible.

1.7  Unless expressly stated to the contrary, to the fullest extent permitted by law, Cycle Scene shall not be liable for any direct, indirect, incidental, special or consequential damages or lost profits that result from the use or inability to use the website and/or any websites which are linked to this site howsoever such damages arise.

1.8 We reserve the right to edit and update our terms and conditions from time to time. 

1.9 If any of these terms are found to be invalid by a court or at law then the remainder of these terms and conditions shall continue to apply.

1.10 These terms and conditions shall be governed by and construed in accordance with English Law and subject to the exclusive jurisdiction of the English Courts. 

1.11 Neither you nor we intend any third party to be able to enforce these terms and conditions pursuant to the Contracts (Rights of Third Parties) Act 1999.

1.12 These terms and conditions constitute the entire agreement between the parties and supersede any and all preceding or contemporaneous agreements between you and Cycle Scene.

2 Placing Orders

2.1 All orders placed by you on this website shall be subject to acceptance in accordance with these terms and conditions.

2.2 Acceptance of your order will take place on despatch of the goods to you and the contract between you and Cycle Scene for the sale and purchase of the goods will be completed at that point, unless we have notified you that we have not accepted your order or we have received notification from you that you wish to cancel your order.    

2.3 All orders placed are subject to stock availability.

2.4 Under the United Kingdom’s Distance Selling Regulations you have the right to cancel your order and receive a full refund. Order cancellations must be made in writing within 7 days of placing your order. If you wish to cancel or amend your order you may contact us by

3 Payment

3.1 We take payment from your card (using a secure on-line payment facility) at the time we receive your order once we have verified your card details and checked stock availability.  All orders are subject to stock availability and in the event that we are unable to supply the goods ordered, we will inform you of this and give you a full refund where you have already paid for the goods.

3.2 All prices quoted include VAT at the UK rate of 17.5%.

3.3 The price you pay for the goods is the price displayed on the website at the time we receive your order, plus an additional charge for postage and packing. The charge for postage and packing is specified at the time you confirm your order (i.e. when the final cost of your order is displayed on screen).

3.4 Whilst we always try and ensure that prices on our website are accurate, in circumstances where errors in the price displayed occur in relation to goods you have ordered, we will inform you of this as soon as possible. You will be given the option to reconfirm your order at the correct price or cancel your order. If you chose to cancel your order you will receive a full refund.

4 Despatch and Delivery

4.1 Goods will be despatched by Courier within 48 hours depending on stock availability and will normally be delivered within a period of 21 days. We make every effort to despatch and deliver goods within these timescales but delays may occasionally occur due to unforeseen circumstances. Cycle Scene is not to be held liable for any delay or failure to deliver goods within the specified estimated time scales.

4.2 The last order date for Christmas 2006 delivery is the 2^nd December 2006.

5 Returns Policy

5.1 You have the right to return goods for any reason within 7 days of receipt. Providing that they are returned unused and in an as-received/resalable condition we will issue a full refund on receipt.

5.2 The returned item is your responsibility until it reaches us and we therefore recommend that you return the item using a delivery service that insures you for the value of the goods. The cost of returning the goods to us is your responsibility.

5.4 Faulty goods will either be replaced or a full refund given.

5.5 If you receive a faulty item please send it to the address given in clause 5.3 stating whether you require a replacement or a refund. At your option we will issue you with a replacement or with a full refund. We will also refund you the cost of returning the faulty item by an agreed courier.

5.6 This returns policy does not affect your statutory rights.

Privacy Policy

Your privacy is important to us. We will only use the information that we collect about you lawfully, in accordance with the Data Protection Act 1998 and the Privacy and Electronic Communications (EC Directive) Regulations 2003 (data protection laws).

We collect information about you for two reasons only. Firstly, to process your order and secondly, to provide you with the best possible service. The information we collect about you includes your name, address, telephone number, email address and account details. In no circumstances do we collect any data that is not directly related to the use of the website. The information we hold is to the best of our ability up to date, accurate and based solely upon information we receive from you. We will not disclose any information about you to any third parties except where this is necessary to fulfil our service to you (e.g. arranging for delivery of your goods).

 If you would like to inspect the data that we hold about you, please write to our Data Manager at the address provided in clause 6 “How to Contact Us”, enclosing proof of identification, a stamped addressed envelope and a cheque for £10 (made payable to Cycle Scene) to cover administration costs.

We will not contact you in the future unless you have given us permission to do so.
